I mean, what kind of **** is that?! I'm very frustrated and mad for their poor customer service. A refund is a refund because i have my receipt and it's the same company, no matter which person gives me a refund. I really hope i can take legal action. Yes you can sue. Now you must decide if you want to hire a lawyer and waste more time and money just to prove a point. First cool down and think about it. I'm guessing there is a owner or a manager right. Ask to see them. Talk to the boss first call to see if he/she will be there calmly explain the situation then ask for a refund. Calm down. You're going to spend thousands in legal fees over a $100 part? Talk about over entitlement. Driving there 4 times is on you, not them.
How did you pay for the part? Did you pay by credit card? If so, you can call up your credit card company and dispute the charge. Most allow this w/in 30 days. Then if you dispute, they don't get their money and when the part comes in, they are stuck with it, since you are not paying for it due to them not completing their promise to have the part w/in 24 hours.
If you paid by cash, then I suggest you find out who the owner is and talk to them. Do not scream, but state firmly that if you had known that this part would take over a week or more, you should have been informed of this. That they should have called you to let you know when it arrived. But for you to drive there so many times makes no sense. Did you call them and ask them if the part arrived? If you did, then that could have saved you time/gas for not driving there.
Yes you can sue, but all you will get is your refund plus court fees. But that would take most likely 6 months or more for a court hearing.
Your best option is that you dispute the credit card charges and move on.
